General Terms and Conditions of M1-Bikes S.L.

1. Rental conditions for motorcycles of M1-Bikes S.L., Mallorca

1. The minimum age to rent one of our Class A motorcycles is 21 years and the rider must have held a motorcycle license for at least 2 years. For Class A2 motorcycles, a minimum age of 18 years is sufficient.

2. Rental

1. a) The subject of the contract between the renter and the landlord is exclusively the temporary provision of the booked motorcycle.

2. b) All prices include 350 km per day (extra kilometers €0.35) and fully comprehensive insurance (deductible €2,500). Fuel costs are not included. Motorcycles are handed over with a full tank and must be returned the same way. Otherwise, a refueling fee of €25 will be charged. The renter is liable for all damages resulting from improper use or self-caused accidents.

3. c) Upon handover, a deposit of €1,500 must be provided by credit/debit card (Mastercard/Visa) or in cash.

4. d) If the motorcycle is returned before the agreed rental period ends, the full rental price must be paid unless the motorcycle can be rented out again.

5. e) The daily rental starts at 10:00 AM and ends at 6:00 PM. Motorcycles can only be rented and returned between 10:00 AM and 7:00 PM.

6. f) A deposit of 20% of the rental price must be paid upon reservation confirmation.

3. Cancellation

1. Cancellation fees: up to 1 week before pickup is free of charge; 7–1 days before pickup: 20%.

4. Obligations of the renter

1. The landlord does not provide compensation or refunds in case of bad weather (individual agreements possible). The renter must treat the motorcycle properly, comply with technical guidelines, and follow traffic laws. The renter is responsible for all fines and penalties incurred.

2. The renter is prohibited from: a) lending the motorcycle to third parties not listed in the contract. b) allowing unlicensed or banned drivers to use it. c) using the motorcycle without a valid license. d) using a technically unsafe motorcycle. e) participating in races. f) using the motorcycle off-road or on beaches. g) tampering with the vehicle. h) selling parts. i) leaving it unsecured. j) using it outside Mallorca (unless agreed).

5. Obligations and liability of the landlord

1. The motorcycle is provided in proper, clean, and roadworthy condition. Previous damages are only recognized if documented in writing.

2. Repairs up to €150 may be carried out without prior approval in emergencies. Receipts must be provided.

3. Tire damage is generally paid by the renter. Further claims are excluded unless due to intent or gross negligence.

6. Liability of the renter for damages

1. The renter is liable for all damages beyond normal wear from the time of handover until return, including negligence, loss, or confiscation.

7. Behavior in case of accidents and damages

1. In case of any damage, the renter must immediately inform the landlord. Services must be coordinated.

2. Police must be notified in case of accidents. Evidence must be secured and no liability admission is allowed.

8. Insurance coverage

1. a) The motorcycle has liability insurance up to €50 million, limited to €8 million per person.

2. b) Motorcycles are insured against damage, theft, and fire. A €1,500 deposit is required and refunded if no damage occurs.

9. Return of the motorcycle

1. The motorcycle must be returned fully fueled and in proper condition with all documents and accessories.

2. Lost keys must be replaced (€250 each). Cleaning costs apply if heavily soiled.

3. The landlord may terminate the contract immediately for valid reasons.

10. Final provisions

1. No side agreements exist. All agreements must be in writing.

2. If any provision is invalid, the rest remains valid.
